Terms of Service

1. Acceptance of Terms

By registering for or using MahutoBulk’s bulk SMS platform, you (“User”, “you”, or “your business”) agree to be legally bound by these Terms of Service. If you do not agree, you must not use the Service. These Terms constitute a binding agreement between you and MahutoBulk (“the Company”).

2. Regulatory Compliance

MahutoBulk operates in compliance with the laws of the United Republic of Tanzania, including but not limited to:

Electronic and Postal Communications Act, 2010 (EPOCA)
Personal Data Protection Act, 2022
Cybercrimes Act, 2015
Regulations issued by the Tanzania Communications Regulatory Authority (TCRA)

Users must comply with all applicable telecommunications and data protection laws.

3. Description of Services

MahutoBulk provides bulk SMS, SMS gateway, and API messaging services. Delivery of SMS is performed on a best-efforts basis: messages are transmitted from MahutoBulk’s systems to recipient mobile network operators via our delivery partners. Final delivery to the recipient’s handset depends on third-party network infrastructure beyond our control, and is not guaranteed.

4. Account Registration & Sender ID

You agree that:

You will provide accurate registration and business information.
You are solely responsible for all messages sent through your account, including their content and the Sender ID used.
You will use only approved Sender IDs (maximum 11 characters), registered and approved through our Sender ID registration process before use.
You will maintain the security of your account credentials and notify us immediately of any unauthorized access.

5. Acceptable Use Policy

You must NOT use the Service to send messages that are:

Spam, or unsolicited commercial marketing sent without the recipient’s consent
Fraudulent, deceptive, phishing, or scam-related — including fake OTP/verification codes intended to deceive recipients
Illegal, harmful, threatening, abusive, hateful, or discriminatory
Political campaign messages without lawful authorization
Pornographic or sexually explicit content
Misleading investment or financial schemes
Otherwise in violation of TCRA regulations or Tanzanian law

We reserve the right to suspend or terminate accounts involved in any of the above without notice.

7. Billing, Credits & Refunds

The Service operates on a prepaid SMS credit basis, purchased through our payment processor, PesaPal. The specific figures below are under internal review and are marked as placeholders rather than guessed, because two existing internal policy documents currently disagree on them:

8. Service Availability & Delivery

Services are provided on an “as available” basis. We do not guarantee:

Uninterrupted or error-free service
100% message delivery — delivery depends on recipient carrier networks beyond our control
Specific delivery times

We may perform scheduled maintenance with advance notice; emergency maintenance may occur without notice. Service may also be affected by network operator outages, regulatory directives, or force majeure events.

9. Intellectual Property

All platform software, design, and content are owned by MahutoBulk.
You retain ownership of your contact data and message content.
You grant us a license to process your data solely to provide the Service.
Our trademarks and logos may not be used without permission.

10. Limitation of Liability

To the maximum extent permitted by law, MahutoBulk shall not be liable for:

Indirect, incidental, or consequential damages
Loss of profit or business interruption
Message delivery failures caused by third-party carrier networks beyond our infrastructure

11. Indemnity

You agree to indemnify and hold MahutoBulk harmless against any claims, fines, regulatory penalties, or damages arising from your misuse of the Service, including messages sent through your account without proper recipient consent.

12. Suspension & Termination

MahutoBulk may suspend or terminate your account if:

You breach these Terms
Required to do so by TCRA or another government authority
Fraud or illegal activity is detected on your account

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United Republic of Tanzania. Any disputes shall be subject to the jurisdiction of Tanzanian courts.
